1. Definitions

  1. The Administrator shall refer to the owner of the Service and administrator of the Website, identified by the alias Kay and PGP key fingerprint: 18A7 9A85 4A65 5343 1815 63E3 B93F C393 04A4 D69B.
  2. The Service, CS (Concierge Service), PSS (Private Shopper Service) shall refer to the act of placing an order at a third-party website for a product or service on behalf of the Customer.
  3. The Customer, You shall refer to the person or legal entity requesting Service by entering their Order details on the Website or via email at orders@kayone.pro.
  4. The Website shall be the web application available at https://kayone.pro/concierge.php.
  5. The Order shall be a singular request made by the Customer by submitting the form on the Website or by sending an email to the Administrator, which contains all details necessary for performing the Concierge Service.
  6. The Vendor shall be the person or legal entity providing physical or digital goods to the Customer, fulfilling an order placed by the Administrator.

2. Data collection & retention

  1. The Administrator collects the following information from the Customers:
    1. shipping information: full name, and address OR parcel locker ID (if eligible)
    2. contact information: email address, PGP public key (if provided)
    3. order details: links to product listings, order amounts
    4. additional notes explicitly provided by the Customer
    5. the number of orders associated with a given email address
  2. The Customer data is shared with third parties as follows:
    1. If Proxy Delivery is not used, order details and shipping information are shared with the Vendors as required
    2. If Proxy Delivery is used, only necessary order details are shared and no personal information is obtained by third parties
    3. If requested by the Customer, additional information is shared with the Vendors, such as variant information
  3. The contact information provided is only used for communication between the Administrator and the Customer. Any relevant correspondence between the Vendor and the Administrator, such as tracking information is forwarded to the Customer by the Administrator
  4. Customer data is disposed of by the Administrator after completing the order, unless data retention is requested by the customer by checking 'Remember shipping info for future transactions' on the order page, in which case the data in held securely on Administrator-owned hardware, which implements adequate measures against unauthorised access.
  5. The number of orders associated with the email address is saved even without the above checkbox ticked. It's only used for determining high-volume customers and subsequently expanding their order limits.
  6. Data deletion can be requested by contacting the Administrator directly at kay@kayone.pro and requesting deletion. If the sender email is not the same as the one used for ordering, additional proof of ownership may be required.

3. Service pricing

  1. Every order placed on the Website or via email is subject to a service fee. The fee keeps the Service running and allows to cover server and currency conversion costs.
  2. The fee is calculated as the higher value out of ($5) and (8% of the order total). In simple terms:
    1. for orders below $62.50 or equivalent there's a flat fee of $5
    2. for orders of $62.50 or equivalent or above the fee is 8% of the total order value
  3. The Administrator reserves the right to lower the fee for particular Customers, especially ones with a long partnership history. The decision always belongs to the Admin, and begging for lowering the fee will result in a temporary or permanent ban from using the Service.
  4. Customers residing outside of the EEA should take notice of their country's customs process before using the Service.

4. Proxy Delivery

  1. In cases where increased privacy is desired, or when the Vendor doesn't ship the items directly to the Customer's location but shipping to Poland is available, the Administrator provides a two-step delivery method at no additional cost apart from the second shipping fee.
  2. For Customers residing in Poland, multiple shipping options are available, including: InPost, Poczta Polska, DPD Pickup and ORLEN Paczka. Shipping cost will be calculated based on the chosen provider's rates.
  3. For international Customers, delivery is handled via Poczta Polska. The shipping rates can be retrieved from this link.

5. Order limitations

  1. All items ordered via the Service must be legal to obtain and trade in Poland and the country of destination.
  2. For new customers or customers with less than 5 completed orders there's a fixed limit of PLN 2000 or equivalent per order.
  3. Customers with more than 5 completed orders will have the above limit extended to PLN 10000 or equivalent.
  4. The need for an order exceeding PLN 10000 equivalent must be discussed with the Administrator. These large orders might have a higher processing time than usual.

6. Refund policy

  1. If an item hasn't been picked up by the Customer and is returned to the sender and the item is eligible for return to the Vendor and after the Vendor refunds the Administrator in fiat currency, the Customer will be contacted for a refund.
  2. The refund amount reflects the amount credited by the Vendor to the Administrator.
  3. The service fee is non-refundable, also in cases where the initial $5 confirmation fee was paid but the Customer failed to follow up with paying the invoice. This 'draconian' practice is used to prevent spammers from creating fake orders, paying the confirmation fee and then requesting a refund on it.

7. Limited liability

  1. The Administrator is not liable for unreliable Vendors. The Customer should not place an order for an item from an untrusted vendor.
  2. Undelivered packages are the Administrator's responsibility only when using Proxy Delivery.
  3. The Administrator takes no responsibility for misleading third-party listings.
